1. Scope and Provider

1.1 These General Terms and Conditions (AGB) apply to all contracts concluded between Name the Pen, [Hohenbergringstr. 116, 53940, Germany ("We"), and the customer ("Customer") via our online shop.
1.2 Our books and goods are sold exclusively to consumers, unless a separate B2B agreement has been made. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

2. Conclusion of the Contract

2.1 The presentation of products in our online shop does not constitute a legally binding offer, but rather an online catalog without obligation.
2.2 By clicking the "Buy Now" button, the Customer makes a binding offer to purchase the goods in the shopping cart.
2.3 We will send the Customer an automatic order confirmation via email immediately after the order has been submitted. This confirmation does not constitute acceptance of the contract; it merely documents that the order has been received. A contract is only concluded when we explicitly accept the order in a separate email or dispatch the books.

3. Right of Withdrawal (Widerrufsrecht)

3.1 Consumers in Germany and the EU generally have a statutory right of withdrawal.
3.2 You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you (or a third party indicated by you, other than the carrier) acquire physical possession of the goods.

You may use the statutory model withdrawal form, but it is not obligatory.

4. Prices and Shipping Costs

4.1 The prices stated in our online shop include the applicable statutory German Value Added Tax (VAT).
4.2 For orders within Germany, shipping costs apply as stated in the ordering process unless a free shipping threshold has been reached. Books are legally bound by fixed book prices (Buchpreisbindung) in Germany; therefore, the publisher's fixed price applies to all new book releases.

5. Payment Conditions

Payment can be made via the following methods:

  • PayPal

6. Delivery

6.1 Unless otherwise agreed, delivery shall be made to the delivery address specified by the Customer.
6.2 If delivery of the book is not possible because the goods are not in stock through no fault of our own, we will inform you immediately and refund any payments already made without delay.

7. Retention of Title

The goods shall remain our property until full payment has been received.

8. Statutory Liability for Defects (Gewährleistung)

The statutory rights of liability for defects apply. Consumers have the right to claim for defects within the statutory warranty period of 2 years from delivery of the goods.

9. Final Provisions / Dispute Resolution

Contracts between the Provider and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
