1. Scope and Provider

1.1 These General Terms and Conditions apply to all contracts concluded through the online store at www.thatsriver.com between Miriam Abel, a sole proprietor, doing business as “Name the Pen,” Hohenbergringstr. 116, 53940 Hellenthal, Germany, email: contact@thatsriver.com, hereinafter referred to as the “Provider,” “we,” or “us,” and customers.

1.2 The product offering is intended exclusively for consumers, unless a separate agreement with a business is expressly entered into in individual cases. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their self-employed professional activities.

2. Conclusion of the Contract

2.1 The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

2.2 The customer may initially add products to the shopping cart without obligation and may correct their entries at any time before submitting the order. By clicking the “Buy” button, the customer submits a binding offer to enter into a purchase contract for the goods contained in the shopping cart.

2.3 Upon receipt of the order, the customer will receive an automatic order confirmation via email. This order confirmation merely documents the receipt of the order and does not constitute acceptance of the offer, unless expressly stated otherwise.

2.4 The contract is concluded when we expressly accept the order via email or ship the ordered goods.

3. Right of Withdrawal

Consumers are entitled to a right of withdrawal in accordance with statutory provisions. Details are provided in the separately provided withdrawal policy and the model withdrawal form.

4. Prices and Shipping Costs

4.1 All prices listed in the online store are final prices. In accordance with § 19 of the German Value-Added Tax Act (UStG), no value-added tax is charged and is therefore not shown.

4.2 In addition to the listed product prices, shipping costs may apply. The amount of the shipping costs is clearly displayed to the customer during the ordering process before the order is placed.

4.3 To the extent that books are subject to fixed book prices, the prices set by law or by the publisher apply.

4.4 Any delivery times are specified in the product details or during the ordering process.

5. Terms of Payment

5.1 The payment methods available in the online store are displayed to the customer during the ordering process.

5.2 Currently, the following payment methods are available: credit card, PayPal, Klarna, iDEAL/Wero, and other payment methods displayed during the ordering process.

5.3 Payment processing may be handled by external payment service providers. The terms and conditions and privacy policies of the respective payment service provider also apply to the payment, to the extent that they are effectively incorporated into the payment process.

6. Delivery

6.1 Delivery will be made to the shipping address provided by the customer during the ordering process, unless otherwise agreed.

6.2 The delivery time is specified in the product details or during the ordering process.

6.3 If delivery is not possible for reasons beyond our control, we will notify the customer immediately. In this case, any payments already made will be refunded immediately.

6.4 If delivery fails because the customer provided an incorrect or incomplete delivery address or unjustifiably refused to accept the shipment, any additional costs incurred as a result may be charged to the customer, provided the customer is responsible for such failure.

7. Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

8. Statutory Liability for Defects

The statutory rights regarding liability for defects apply.

9. Final Provisions / Governing Law

9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

9.2 With respect to consumers, this choice of law applies only to the extent that it does not restrict mandatory consumer protection provisions of the country in which the consumer has his or her habitual residence.

10. Consumer Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
